Smoking in shared houses

What does this mean for the living areas in shared houses? If the tenants all have individual tenancy agreements for their own rooms, then the shared parts of the house fall within the regulations and they cant smoke. However for a joint tenancy, it will depend on the terms of the tenancy agreement. Tenants in bedsits with their own tenancy agreement or houses and flats rented under the one tenancy agreement where the landlord permits smoking, this is not illegal. If smoking is not permitted and you decide to smoke anyway, in breach of a term within your tenancy agreement, this is potentially a ground for possession.

Many landlords do not allow smoking within the property for lots of reasons including the risk of fire. Something you should also consider is the impact on your deposit, should you decide to smoke in the property either with or without permission, the impact this may have on the decor, could result in the landlord withholding some of your deposit due to the discoloration of the decor and any soft furnishings provided not to mention the need for extensive cleaning required before new tenants can move in.
